1. Scope of application

The following terms and conditions apply for all orders in our online shop.

2. Contracting parties, conclusion of contract

The purchase agreement is concluded with YippieYo GmbH & Co. KG, Im Himmel 74, 70569 Stuttgart. By publishing products in the online shop, we make a binding offer to conclude a contract for those items. The contract comes into being upon you accepting the offer for the goods in the shopping cart by clicking the order button. You will receive confirmation by e-mail again immediately upon submitting the order. A binding contract can also come into being before that point in the following ways:

If you have chosen SEPA Direct Debit, the contract comes into being upon the debit date being notified (pre-notification).
If you have chosen instant transfer as the payment method, the contract comes into being upon confirmation of the payment instruction to SOFORT AG.

3. Shipping costs

In some countries, shipping costs may apply in addition to the specified product prices. More information about the shipping costs can be found in the product descriptions.

4. Cancellation policy

Right to cancel

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period of 14 days begins on the day that the goods are first received by you or by a third party specified by you who is not the carrier. For services (e.g. orders for test models), the cancellation period begins on the day that the contract is concluded.

To exercise your right to cancel, you must notify us (YippieYo GmbH & Co. KG, Im Himmel 74, 70569 Stuttgart, service@yippieyo.com) of your decision to cancel this contract. This must be done by means of a clear statement (e.g. a letter or e-mail). You may, but do not have to, use the provided cancellation form template. Sending the cancellation notice before the end of the cancellation period is deemed sufficient for observing the cancellation period.

Consequences of cancellation for goods within the EU

If you cancel this contract, we will refund all payments that we have received from you, including shipping costs (except the extra cost of selecting a delivery option other than the cheapest one that we offer, i.e. standard delivery). We will provide this refund immediately but no later than 14 days after the day on which we received your notice to cancel this contract. For this refund, we will use the same payment method that you used for the original transaction, unless specifically agreed otherwise with you; under no circumstances will you be charged any fees for this refund. We are entitled to refuse the refund until we have received the goods again or until you have proved that you have sent back the goods, whichever is the earlier.

You must send back or hand over the goods to our logistics partner Wiedmann & Winz GmbH immediately but no later than 14 days after the day on which you notified us that you wish to cancel this contract. This deadline will be deemed to have been met if you send the goods before expiry of the 14-day period. For goods that can be sent by parcel or shipped, you are responsible for paying the direct costs associated with returning the goods. For goods that cannot be returned by post due to their nature, the cost of return is EUR 10.00 in Germany, EUR 15.00 in Austria and an estimated EUR 50.00 in other countries. This deadline will be deemed to have been met if you send the goods before expiry of the 14-day period. Please follow our returns process. When returning goods within Germany and Austria, please use the GLS returns label enclosed with the goods. More information about our returns process can be found here and on the information sheet enclosed with the goods.

If the goods have diminished in value, you will only have to pay for this loss of value if it resulted from handling the goods beyond what was necessary to check their nature, characteristics and functionality. If you wish to test the Crossbuggy extensively outdoors, we recommend that you first order a test model to avoid any signs of use and/or damage.

Consequences of cancellation for services within the EU

If you have asked for the services to commence during the cancellation period, you must pay an appropriate amount that corresponds to the proportion of services already provided in relation to the overall scope of the services under the contract up until the time that you notified us that you wish to exercise your right to cancel this contract.

Goods not included under cancellation policy

Unless agreed otherwise between the parties, the right to cancel does not apply to the following contracts:

Contracts for the delivery of goods that are not prefabricated and the production of which requires an individual selection or decision by the customer or which have clearly been customised to the personal preferences of the customer.

5. Payment

We offer the following payment methods in our shop:

Credit card – Your credit card is charged upon us accepting your order. More information about which credit cards we accept can be found under Payment methods.

PayPal

Pre Payment

Instant transfer – We also offer the option of paying by instant transfer. With his method, we receive the transferred funds immediately, which speeds up the entire order process. You only need an account number, sort code, PIN and TAN. Using the secure Sofort AG payment form, which cannot be accessed by the retailer, the automated system sets up an instant transfer in your online bank account in real time. The amount is immediately transferred directly to the retailer’s bank account. When choosing instant transfer as the payment method, a form will open at the end of the order process, pre-populated with our bank details, the amount to be transferred and the payment reference. You then have to select the country in which your bank account is based and also enter the sort code. You then enter the same data that you use to log into online banking (account number and pin). Confirm your order by entering the TAN. The transaction is then confirmed immediately. In principle, anyone who has an online banking account which uses the PIN/TAN procedure can choose instant transfer as their payment method. Please note that instant transfer is not yet offered by some banks. 6. Collection

Ordered goods can only be shipped. They cannot be collected from our premises.

7. Packstation

We do not deliver to Packstations.

8. Retention of title

The goods remain our property until they have been paid for in full.

9. Transit damage

If goods are delivered with obvious transit damage, please submit a complaint to the delivery company as soon as possible and contact us. Failure to lodge a complaint or contact us will in no way affect your statutory entitlements and the enforcement thereof, especially your warranty rights. However, you will help us to assert our own claims towards the freight carrier and the transport insurance provider.

10. Hiring of test models

Customers in Germany can hire a test model. The maximum hire period is two weeks. Prices, payment terms and shipping costs are published on the website under view and test.

A deposit of EUR 600 is payable for the hire. If the test model is not returned within the agreed period, the deposit will be retained. The hire model is a used product. The colour of the seat covers cannot be freely selected. The hirer is liable for any damage resulting from improper use. Incidentally, by not using the goods as though they were your property, and by refraining from any actions that could reduce their value, you can avoid having to pay compensation for damage resulting from improper usage.

The goods must be returned in the same packaging. The cost of shipping and return is included in the hire price.

12. Storage of contract text

We will store the contract text and send you the order details and our terms and conditions by e-mail. You can also view the terms and conditions at any time here on this page. For security reasons, your order history will no longer be available online.

13. Contractual language

The contract may be concluded in German or English.

14. Place of jurisdiction

The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the supplier is at the registered address of the supplier (Schwyz district court, Switzerland), provided that the customer is a merchant, a legal entity under public law or a special fund under public law.

15. Severability clause

Should one of the provisions of these terms and conditions be invalid, this shall not affect the validity of the remaining provisions.
